Terms of Service

These Terms of Service ("Terms") govern your access to and use of SwapFob (the "Service"), operated by SwapFob in the United States. By creating an account or using the Service, you agree to these Terms.

The Service

SwapFob provides digital access badges that members add to Apple Wallet and Google Wallet, along with a dashboard for managing badges, locations, and scanning. We may update, add, or remove features at any time.

Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to create an account.

Your responsibilities

• You are responsible for the badge holder information you upload, and you represent that you have the right to share it with us.
• You agree not to misuse the Service, interfere with its operation, or use it for unlawful purposes.
• You are responsible for complying with any laws that apply to your use of access control and personal data in your jurisdiction.

Plans and billing

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law. We offer a free plan with limited features.

Cancellation and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if required to do so by law.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. SwapFob is an access-management tool and is not a substitute for physical security measures. We do not guarantee that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, SwapFob will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from unauthorized access, lost data, or interruption of the Service. Our total liability will not exceed the amount you paid us in the twelve months before the claim.

Governing law

These Terms are governed by the laws of the United States and the state in which SwapFob operates, without regard to conflict-of-law rules.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Continued use of the Service after changes take effect means you accept the updated Terms.
